Employer Nomination Scheme – Subclass 186

This visa is for skilled workers nominated by their employer to live and work in Australia permanently, available in 3 streams:

  • Temporary Residence Transition Stream
  • Labour Agreement Stream
  • Direct Entry Stream

Temporary Residence Transition Stream

For applicants have worked with the employer on a 482 visa for the last two years regardless of what stream your occupation falls under, you can transition to PR.

Other requirements include:

  • You must be under 45
  • You must achieve Competent English before lodging the application
  • Meet certain health and character requirements
  • Employer must demonstrate a genuine need for this position and that the full-time position would continue to be available for at least 2 years
  • Employer must demonstrate financial viability to meet financial obligations associated with the proposed employment

Labour Agreement Stream

For applicants who hold a 482 visa. Where the employer has a Labour Agreement and sponsors their employee.

Direct Entry Stream

For highly skilled individuals to obtain permanent residency directly without having first demonstrated work experience with sponsor.

Other requirements include:

  • You must be under 45
  • You must achieve Competent English
  • Meet health and character requirements
  • Provide a positive skills assessment for your occupation
  • Demonstrate at least 3 years relevant work experience in their occupation
  • Employer must demonstrate a genuine need for this position and that the full-time position would continue to be available for at least 2 years
  • Employer must demonstrate financial viability to meet financial obligations associated with the proposed employment

186 visas require a significantly higher level of documentation than a 482 visa. Difficulties which can be encountered in applying for 186 visas include:

  • Obtaining skills assessments – each skills assessing authority has different criteria
  • Demonstrating that the employer has a genuine need for a permanent position
  • Meet licencing and/or registration requirements
